Untapped Cities – Terms & Policies

These Terms & Policies govern all bookings, memberships, tours, events, and related services offered by Untapped Cities LLC (doing business as Untapped New York). By purchasing a ticket, booking a private tour, becoming a member, or otherwise participating in our experiences, you agree to the following.

1. Company Information

Legal entity: Untapped Cities LLC
Operating name: Untapped New York
Services: Guided walking tours, private tours, ticketed events, memberships, and related educational experiences.

2. Booking & Payment Terms

2.1 Public Tours

  • Full payment is required at the time of booking.
  • Prices are listed per person unless otherwise stated.
  • All listed prices include applicable taxes and standard inclusions unless explicitly noted.

2.2 Private Tours

  • Private tours are priced as a flat fee for a defined group size, with per‑guest pricing for additional participants when applicable.
  • Full payment is required to confirm a private tour unless otherwise agreed in writing.

2.3 Accepted Payments

  • Credit and debit cards are accepted via our authorized booking platforms.
  • We do not accept cash on site unless explicitly stated.

3. Cancellation & Refund Policy

3.1 Public Tours

  • Full refund for cancellations made more than 24 hours before the scheduled start time, unless specified otherwise.
  • Ellis Island–related tours: Full refund for cancellations made more than 72 hours before the scheduled start time.
  • No refunds for late arrivals or no‑shows.

3.2 Private Tours

  • Full refund for cancellations made more than 72 hours before the scheduled start time.
  • No refunds for cancellations within 72 hours, late arrivals, or no‑shows.

3.3 Operator Cancellations

If Untapped Cities cancels a tour due to weather, force majeure, safety concerns, or operational issues, guests may choose one of the following:

  1. Transfer tickets to the same tour on a different date or time.
  2. Transfer tickets to another comparable Untapped Cities experience.
  3. Receive a full refund.

4. Membership Terms

4.1 Membership Benefits

Memberships provide access to complimentary or discounted tours, members‑only events, and other benefits as described at the time of purchase.

4.2 Billing & Renewal

  • Memberships are billed on a recurring monthly or annual basis, depending on the plan selected.
  • Memberships automatically renew unless canceled.

4.3 Cancellation of Membership

  • Members may cancel at any time through their account portal.
  • Benefits remain active until the end of the current billing period.
  • No partial refunds are issued for unused time or benefits.

5. Tour Participation & Conduct

5.1 Arrival & Punctuality

  • Guests are expected to arrive at least 10 minutes before the scheduled start time.
  • Tours start promptly. Late arrivals may not be able to join once the tour has departed.

5.2 Accessibility

  • Walking tours involve extended periods of standing and walking on city streets.
  • Accessibility details are provided on individual tour pages. Guests with specific needs should contact us prior to booking.

5.3 Guest Conduct

  • Guests must follow all instructions provided by guides.
  • Disruptive, unsafe, or disrespectful behavior may result in removal from the tour without refund.

6. Audio Equipment

For most tours, Untapped Cities provides guests with a discreet wireless audio earpiece so they can clearly hear the guide while maintaining a comfortable distance. Equipment must be returned at the end of the tour. Lost or damaged equipment may be charged to the guest.

7. Weather Policy

Tours operate rain or shine unless conditions are deemed unsafe. In cases of severe weather or official advisories, Untapped Cities may modify, reschedule, or cancel tours in accordance with Section 3.3.

8. Photography & Media

By participating in a tour or event, guests grant Untapped Cities the right to use photographs or video recordings taken during the experience for marketing and promotional purposes, unless a written opt‑out request is submitted prior to the tour.

9. Assumption of Risk & Liability Waiver

Guests voluntarily assume all risks associated with walking tours and urban environments, including but not limited to uneven surfaces, traffic, weather conditions, and crowds. To the fullest extent permitted by law, Untapped Cities LLC is not liable for personal injury, loss, or damage to personal property during participation.

10. Third‑Party Sites & Attractions

Some tours include or reference third‑party venues, transportation, or ticketed attractions. Untapped Cities is not responsible for changes, closures, or policies imposed by third parties.

11. Changes to Tours & Policies

Untapped Cities reserves the right to update itineraries, pricing, inclusions, and these Terms & Policies at any time. The version in effect at the time of booking governs the transaction.

12. Governing Law

These Terms & Policies are governed by the laws of the State of New York, without regard to conflict of law principles.
